Terms of service

The agreement between you and us: what we provide, what we charge, what we promise, and, importantly for this kind of product, what we can't promise.

1. The agreement

These terms apply when you create a Vizebel account or use the service. If you are agreeing on behalf of a company, you confirm you have authority to do so, and “you” means that company.

2. What the service does

Vizebel helps you plan and improve your website content. It reads your website and published content, brings in your Google data when you connect it, asks AI assistants questions about your business and category and records their answers, and produces reviews, recommendations, reports and drafts from what it finds. You decide what to publish.

3. What we can’t promise

This section matters more than most, so it is in plain language.

We do not control what AI assistants say. ChatGPT, Gemini, Claude and Google’s AI Overview are operated by third parties. Their answers change over time, vary between runs, and are outside our control and yours. We make no guarantee that your brand will be mentioned, recommended, ranked or cited by any assistant, at any time, as a result of using this service.

Readings are measurements, not predictions. A result tells you what an assistant said when we asked. It does not guarantee what it will say next time, or what it says to any particular person.

Generated content needs a human. Drafts and recommendations are produced with AI assistance and may contain errors, or claims about your business that are not accurate. You are responsible for reviewing, editing and fact-checking anything before you publish it.

The service is provided “as is”. To the extent the law allows, we exclude implied warranties. Nothing in these terms limits rights you have under the New Zealand Consumer Guarantees Act or other laws that cannot be excluded, though note that the Act generally does not apply where goods or services are acquired for business purposes.

4. Your account

Keep your login credentials secure and let us know promptly if you think someone else has access. You are responsible for what happens under your account, for the people you invite into your organisation, and for any app you connect to it, such as Claude, which acts within the access you approve.

5. Acceptable use

You agree not to:

Use the service to monitor or generate content for a brand you have no legitimate connection to or authority over; attempt to break, overload or reverse-engineer the service; resell access without an agency arrangement with us; or use it to produce content that is unlawful, deceptive, defamatory or infringing.

Agencies and consultancies may absolutely run the service for clients: that is an intended and supported use, covered by an agency plan.

6. Credits, plans and payment

Paid plans include a monthly allowance of credits, which is replaced (not added to) at the start of each billing cycle and does not roll over. Credits purchased separately as top-ups do not expire and are used only after your plan allowance is exhausted.

Credits are consumed when work starts. If a page review, technical check or rewrite fails before it produces a result, its credits are returned. A snapshot you switch to re-run monthly uses credits each month until you switch it off. Reading previously generated reports does not consume credits. Fees are charged in advance and, except where the law requires otherwise, are non-refundable. You can cancel at any time; cancellation takes effect at the end of the current billing period. When a plan ends, any unused plan allowance expires; top-ups and free credits stay in your account.

We may change prices with at least 30 days’ notice to existing customers before the change applies to your subscription.

7. Who owns what

You own your content. Your brand information, questions, edits and the drafts generated for your workspace are yours. You may use, edit and publish them freely, including commercially.

We own the platform. The software, interface, methodology and documentation remain ours. You get a licence to use them while your account is active.

You grant us the limited licence needed to operate the service for you: to process your content, send your questions to assistant providers, and store your results. We do not use your content to train models.

8. Third-party providers

The service depends on third-party providers, including the AI assistants it measures and the services we use for search data, sign-in, payments and hosting. If one of them changes their service, restricts access, or goes down, parts of Vizebel may be affected. We will work around it where we reasonably can, but we are not liable for their acts or omissions.

9. Liability

To the maximum extent permitted by law, neither party is liable for indirect or consequential loss, including lost profits, lost revenue or lost business opportunity. Our total liability arising from the service is limited to the amount you paid us in the three months before the claim arose.

10. Suspension and termination

You can close your account at any time by emailing us. We may suspend or close an account that breaches these terms, doesn’t pay, or puts the service or other customers at risk, with notice where it is reasonable to give it. When an account closes, access ends immediately and its data is erased 30 days later; ask us before then if you want a copy.

11. Changes to these terms

We may update these terms. If a change materially affects you, we will notify account holders by email before it takes effect. Continuing to use the service after that means you accept the updated terms.

12. Governing law

These terms are governed by the laws of New Zealand, and the New Zealand courts have non-exclusive jurisdiction over any dispute.

13. Contact
